The Society for the Study of Modern Visual Culture (Gendai Shikaku Bunka Kenkyukai), also known as Genshiken, is created and organized by Lasallians who believe that Religio, Mores, and Cultura live in Art. Genshiken is born with the aim to promulgate modern visually-oriented culture, and believes that these can be of very good use as instruments to channel every Lasallian’s talent and love for arts and craft.
The very essential goal of Genshiken lies in its dream to be one of the De La Salle University’s pools of talents, where students will be given the chance to hone their talents, love their craft, relieve their pressures thru recreation, and create bonding to other Lasallians who have the same interests and love for Anime, Games, Manga, and Art, hence promoting unity to its members.
We voluntary organized ourselves in order to foster unified sense of self-trust in whatever artistic talent God has given us. Genshiken will therefore do its best to cater those interests, by ordaining and promulgating this constitution.
Article I
Name and Nature of Organization
Section 1.1. The organization shall be named “The Society for the Study of Modern Visual Culture (Gendai Shikaku Bunka Kenkyukai)” thereafter known as “Genshiken”. The name was chosen to imply that this organization will serve its purpose in catering Lasallian’s talent through Modern visually-oriented arts.
Section 1.2. The group shall be called an organization, to imply that the organization unites itself to be one of the Genshiken’s tools for its goal to promulgate the three Lasallian values and traditions: Religio, Mores, and Cultura.
Section 1.3. Genshiken shall have its seal. The official seal shall serve its purpose of promulgating the essence of the organization. It is therefore the spirit of the club, more than its emblem.
Section 1.4. Genshiken’s aim as an interest organization of De La Salle University – Dasmariñas is to serve as a vehicle and a channel for anime, game and manga fans to direct, use, and hone their talents in drawing, story writing, digital designing, and other artistic talents.
Section 1.5. Genshiken will be composed of anime game manga and art enthusiasts, driven by the need to furthermore enhance and express their talents, on support for art.
Section 1.6. Genshiken shall have its goal towards recreation and learning, serving Lasallians’ unquenchable for love of their talent and craft.
Section 1.7. Genshiken, being a Lasallian in nature, will continue to seek intercession of God and St. John Baptist De La Salle, and will continue its purpose of applying the Lasallian values and tradition, as well as the University’s Vision and Mission through modern visual arts.
Article II
Purpose and Objectives
As said earlier, Genshiken’s belief that Religio, Mores and Cultura are in art is one of the reasons why the organization strives hard in promulgating Modern Visual Arts. We believe that these arts are effective tools for students to express their talents, and hone their craft. The objectives will be therefore expressed using the three Lasallian traditions that shapes every Lasallian, and in turn, shapes Genshiken’s goals too.
Section 2.1. Religio
2.1.1. One of the Genshiken’s goals is to hone the talents of every Lasallian artist. We believe that those God-given talents should be used in order to serve its purpose to God, and to the Lasallian community.
2.1.2. God has His purpose of giving talents to people . Genshiken will do its best to make its members see that talents are given to be used, and used only for good, for the sake of fulfillment of God’s purpose on them.
2.1.3. To seek intercession from God and St. John Baptist De La Salle, for the members to realize that God gave them their talents because of His love. The talents should therefore be used with love.
Section 2.2. Mores
2.2.1. Genshiken firmly believes in morality. It should therefore promulgate its love for its crafts with guidance of moral law.
2.2.2. Genshiken will always consider morality in practicing its love for Art, Anime, Games, and Manga. Therefore, Genshiken, its officers and members, should never have blind and clouded views on the morality of their craft.
Section 2.3. Cultura
2.3.1. Anime, Manga, and story writing art, are Genshiken’s main tools in order to spread the Filipino, and the La Sallian culture. One of the Genshiken’s goals therefore, is to promulgate otaku culture through modern arts.
2.3.2. Having the Lasallian tradition in mind, Genshiken shall therefore be responsible and sensible in promulgating the valueof both Lasallian and otaku culture through art.
2.3.3. To shape one’s own totality, not just have an open mind but alsoright mind, in order to see culture as one that hones one’s self.
Article III
Officers
Section 3.1. Election
3.1.1. There shall be a Commission on Elections, which shall be composed of all major outgoing officers, being chaired by the President.
3.1.2. The COMELEC shall be the sole body that shall settle and/or decide all electoral disputes.
3.1.3. The COMELEC during its deliberation shall create policies for election of the incoming officers. A list of official candidates should be presented two (2) weeks before the election.
3.1.4. A pre-assembly of all the official candidates and members should take place on a day set by the COMELEC.
3.1.5. The manner of election shall be:
· Nomination
· Seconding the nomination
· Announcing the official candidates
· Casting of votes (thru secret balloting)
· Tabulation
· Declaration of winners
3.1.6. The order of election shall be from President to PRO.
3.1.7. A re-election shall take place when there is a case of a tie for the said position.
3.1.8. The election shall be scheduled two months before the final examination of the second semester.
Section 3.2. Qualifications
3.2.1. Must not hold any other position in any recognized organizations in the university upon elections.
3.2.2. Must be recommended by the general welfare of the organization.
3.2.3. Has not committed any violation on the university’s regulations.
Section 3.3. Functions and Rights
The Genshiken’s Executive Board of Officers shall be composed of the President, Vice President, Secretary, Assistant Secretary, Treasurer, Auditor, Business Manager, and Public Relations Officers (3).
3.3.1. President
(a) The President shall be the official head of Genshiken.
(b) The President shall be the overall coordinator of activities of Genshiken.
(c) The President shallpreside over all the meetings of the organization.
(d) The President shall determine the Order of Business of every meeting.
(e) The President shall have the authority to create committee/s as he/she deems necessary, authorize expenditures, and prescribe duties to other officers and members.
(f) The President shall enforce all policies approved by the Genshiken officers and members.
(g) The President shall lead the members in carrying out the activities in attaining the purpose and objectives of the organization.
3.3.2. Vice President
(a) In the absence of the President, the Vice President shall take charge.
(b) The Vice President must assist the President in carrying out the objective of Genshiken.
(c) The Vice President shall carefully monitor the performance of other officers and members, and may perscribe duties to those with implicit approval of the President.
(d) The Vice President shall perform such other duties and functions as may, from time to time, be assigned by the President.
3.3.3. Secretary
(a) The Secretary shall take down minutes of all Genshiken meetings.
(b) The Secretary shall prepare and serve due notice all meetings of the members and of the officers.
(c) The Secretary collects, maintains, and updates all documents, membership profiles, as well as records of Genshiken. The Secretary shall also have the secretarial and organizational records.
(d) The Secretary shall become the Ad-interim President of the organization in the event of vacancies in both positions of President and Vice President, until such time when the organization members elect the successors.
(e) The Secretary shall perform such other duties and functions which may be assign by the President.
3.3.4. Assistant Secretary
(a) The Assistant Secretary shall assist the Secretary in his/her duties.
(b) The Assistant Secretary shall take over on the duties of the
Secretary upon his/her absence.
(c) The Assistant Secretary shall perform such other duties and functions which may be assigned by the president.
3.3.5. Treasurer
(a) The Treasurer shall act as the custodian of all funds and properties of Genshiken.
(b) The Treasurer shall be in-charge of collecting, under proper receipts, all the fees, dues and fines from the members.
(c) The Treasurer shall disburse with accompanying vouchers all payments and expenses duly authorized by the President and the Adviser.
(d) The Treasurer shall keep books and records of accounts.
(e) The Treasurer shall make and present during every general meeting, the reports of financial operations and statements of financial condition of the organization.
(f) The Treasurer shall present for review, verification, and certification by the auditor on demand, the funds, and all records pertaining to the collections and disbursements.\
(g) The Treasurer shall co-signatory in disbursements of the organization’s funds and withdrawals from the organization’s account in banks.
(h) The Treasurer may ask assistance from other officers of the society concerning purchasing and related materials.
(i) The Treasurer shall prepare the semestral Financial Statements and reports of the organization, certified by the auditor.
(j) Upon termination of office, the Treasurer turnover to the authorized successor the money, books, record, and all other documents necessary to the treasury.
(k) The Treasurer shall perform other duties and functions which may be assigned by the president.
3.3.6. Auditor
(a) The Auditor shall audit all the accountabilities of the funds, records, original and official entries in the book, and the financial activities of the organization.
(b) The Auditor shall determine the fairness and accuracy of the presentation of the Financial Statement/Reports of the organization.
(c) The Auditor shall act as the organization’s property custodian.
(d) The Auditor shall assist the Treasurer in preparing the financial statements/reports.
(e) The Auditor shall perform other duties and functions which may be assigned by the President.
3.3.7. Business Manager
(a) The Business Manager shall assist the President and other officers in the transaction of the organization’s business.
(b) The Business Manager shall be directly responsible for maintaining a good image of Genshiken especially on external affairs.
(c) The Business Manager shall submit and present documents about the organization’s plans for an activity, a fund raising, or a project.
(d) The Business Manager shall contact the concerned people and negotiate the terms and conditions regarding the external business affairs of Genshiken after consulting the other offices.
(e) The Business Manager shall perform other duties and functions which may be assigned by the President.
3.3.8. Public Relations Officer (Internal PRO, External PRO, & PRO for On-line and Technical Affairs (PRO-OTA))
(a) The Internal PRO shall be responsible for disseminating information and other communication to other concerned parties.
(b) The External PRO shall be directly in-charge in promoting the organization’s projects, plans, activities, and undertakings.
(c) The PRO for On-line and Technical affairs shall be responsible in promoting the organization’s projects, plans, activities, and undertakings on the internet. He shall also be responsible for publications design and any computer related matters.
(d) The PROs shall inform the members of the members of the organization as regards all the meetings called upon by the officer.
(e) The PROs shall promote harmonious relationship among the members of the organization; encourage openness, free expression of ideas and one’s self, to foster healthy criticism towards greater efficiency.
(f) The PROs shall perform other duties and functions, which may be assigned by the President.
Section 3.4. Terms of Office
3.4.1. The term of office of Genshiken officers shall be for one (1) school year, unless removed or terminated earlier for just cause, and shall continue to hold such office until their successors shall have been elected and qualified.
3.4.2. Unless otherwise provided, the said term of office shall commence on the date of their induction, and shall expire upon the assumption of office of their successors.
Section 3.5. Removal, Vacancy and Impeachment
3.5.1. Vacancies may occur under following situations:
· Impeachment
· Disqualification
· Resignation
· Failure to Enroll during his term of office
3.5.2. In case of vacancies, appointments shall be made by officers. Such appointments shall follow the qualifications stated in this constitution.
3.5.3. Any Genshiken officers shall be disqualified to continue holding office under following circumstances:
· Failure to enroll during his term of office
· Permanent psychological incapacity
3.5.4. Genshiken Officers shall be subject to impeachment on any of the following grounds:
· International violation of the Constitution
· Found guilty of any violations under this Constitution and/or the University body
· Malversation of funds
· Graft and Corruption
· Misrepresentation of the organization
3.5.5. Any of Genshiken’s officers and members may initiate an impeachment complain against any of the Genshiken’s officers.
3.5.6. Cases of impeachment against any of the Genshiken officials shall be investigated, deliberated, and decided upon a committee composed of the other remaining officers, and the Adviser to maintain neutrality.
Article IV
Adviser
Section 4.1. Selection Process
4.1.1. Genshiken shall have an adviser who shall be a full-time faculty member of De La Salle University-Dasmariñas.
Section 4.2. Qualifications
(a) The Adviser shall be recommended by the majority of the Genshiken Executive Board.
(b) The Adviser should have at least one (1) year residency in the University.
Section 4.3. Duties and Responsibilities
(a) To provide guidance particular in the:
· Establishment of strategic direction
· Management of the organization’s affairs particularly in the planning, organizing, directing, and controlling process.
· Implementation of rules, policies, and procedures
· Resolution of leadership problems and cases
(b) To help establish and sustain harmonious relationship within the organization.
(c) To accompany the organization during off campus activities.
· If the Adviser will not be able to do such, the adviser must assist the organization to choose the most qualified faculty to accompany the group.
(d) To advise and give opinions on the activities and matters concerning the organization.
(e) To attend meetings on a regular basis of at least once a month.
(f) To call meetings of Genshiken officers whenever the need arises.
(g) To inform from time to time other matters coming from different offices that concerns the organization.
(h) To perform other duties and responsibilities analogous, related to, and/or implied by virtue of the position of the adviser.
Section 4.4. Terms of Office
4.4.1. The term shall be for one (1) school year, but may be renewed based on the recommendation of the organization.
Section 4.5. Vacancy
4.5.1. If the faculty adviser withdraws before his/her period expires, a new faculty should be recommended for the remaining term.
Article V
Members
Section 5.1. Qualifications
5.1.1. Must be a bonafide student of University.
5.1.2. Must have interest on Anime and other Modern Visual Art.
Section 5.2. Membership
5.2.1. Students that are joined in Genshiken are officially members for one (1) semester, renewable every semester.
5.2.2. Requirement for the members of Genshiken will be held every semester.
5.2.3. Members of Genshiken shall pay a semestral fee payable in cash.
The fee collected shall be resolved by the executive board.
5.2.4. Membership Requirements:
· An accomplished application form
· Two (2) pictures of size 1”x1”
· Copy of the current Registration Form
· List of schedule for the current semester
· Membership Fee
Section 5.3. Functions and Rights
5.3.1. Members of Genshiken shall have the following right and privileges:
(a) The right to participate in the discussion in all the meetings of the organization.
(b) The right to vote, be elected and/or appointed to any official position in Genshiken , provided that he/she complies with all the requirements.
(c) The right to be informed of any project and/or activities of the organization and to participate in such undertaking.
(d) The right to use facilities of the organization provided that it will be used for official business.
(e) The right to volunteer for the well-being of the organization.
(f) The right to participate the objectives of Genshiken thru the vision-mission of the De La Salle University.
5.3.2. Members of Genshiken shall have the following expressed duties
and responsibilities:
(a) The duty to attend meetings, whether regular or special called upon by the executive board.
(b) The duty to comply with the provisions of this constitution and other rules that may be promulgated or agreed upon by the organization.
(c) The duty to attend and participate actively in all of the organization’s activities and functions.
(d) The duty to pay the membership fee and such other fees that may be due in accordance with the constitution.
(e) The duty to comply with any lawful requirements set forth by the organization.
(f) The duty to join a committee in line with his/her interest that would further develop his/her skills.
(g) The duty to attend committee meetings and activities as called by the committee head.
Section 5.4. Termination of Membership
5.4.1. Membership shall be forfeited under the following:
· Being found guilty three (3) times in any of the minor offenses of this constitution or the university body
· Being found guilty in any of the major offenses of this constitution or the university body
· Intentional violation of the constitution
· Found guilty of committing graft, corruption of funds, and anomalies
· Withdrawal of membership / disqualification
· Failure to enroll during his/her term of membership
· Unexcused absence to three (3) activities
Section 5.5 Committees
5.5.1 Art Committee
5.5.1.1 The Art Committee shall be responsible for the artistic side of the members.
5.5.1.2 The Art Committee shall be responsible in forming the drawing tutor team.
5.5.1.3 The Art Committee shall be responsible in providing designs for the organization.
5.5.2 Cosplay Committee
5.5.2.1 The Cosplay Committee Shall be responsible in matters regarding the field.
5.5.2.2 The Cosplay Committee shall be the official cosplay team of the organization.
5.5.3 Performance Committee
5.5.3.1 The Performance Committee shall be responsible for the development of the members’ talents.
5.5.3.2 The Performance Committee shall be the official performers of the organization.
5.5.4 Events management and Productions Committee (EMPC)
5.5.4.1 The EMPC shall be responsible for events preparations and setup.
5.5.4.2 The EMPC shall be responsible for ensuring the good flow of activities.
5.5.4.3 The EMPC shall be the activity marshals.
5.5.5 Publications Committee
5.5.5.1 The Publications Committee shall be responsible for production of Manga, Comics, and other similar works with the help of the Art Committee.
Article VI
Funds
Genshiken’s fund will be composed of membership fee and proceeds from fundraising activities.
Section 6.1 Genshiken shall raise funds to defray its expenses, and to accomplish its objectives and functions.
Section 6.2 Genshiken may conduct a Fundraising Activity. The proceeds of which shall be used to defray its expenses, and to accomplish its objectives and functions.
Section 6.3 Genshiken shall collect membership fees that are reasonable in amount and approved by the executive board.
Section 6.4 Genshiken shall not collect any other dues unless approved by the majority of its constituents.
Section 6.5 Funds not used by the organization during their term shall be transferred to their succeeding officers.
Section 6.6 Transparency and proper accounting shall be observed at all times. Person(s), which will be proven guilty of fraud shall be held liable for their acts.
Article VII
Order of Meetings
Section 7.1 The President shall call the monthly meeting of officers and members at least once a month.
Section 7.2 During the meeting, the President shall render his/her monthly report regarding the activities of the organization.
Section 7.3 Special meetings shall be called by the President whenever needed.
Section 7.4 The Majority shall constitute a quorum present shall be sufficient present a motion.
Section 7.5 Officer shall meet at least twice a month
Section 7.6 The President may call special officer’s meeting anytime designated by him/her.
Section 7.7 Order of business
· Roll call
· Reading and approval of the minutes of the previous meeting
· Report of committees
· Action of committee reports
· Other matters
Article VIII
Grievance Procedures
Any dispute which may arise from an officer’s/member’s/any involved parties’ complaint with respect to the interpretation of the terms and condition of this Constitution shall be subject to the following Grievance Procedure, unless expressly excluded from such procedures by the terms of this Constitution. All Grievances shall be initiated at Step 1. Time limits set fourth herein maybe extended upon mutual agreement of the parties. The involved parties shall have the right to be notified and be present at all steps of the Grievance Procedure.
8.1.1 Step 1: An officer, a member, or any involved party shall present the Grievance to the most immediate officer of the organization who has the authority to make adjustments in the matter within 14 days of the alleged Grievance of knowledge thereof.
8.1.2 Step 2: If a satisfactory settlement is not reached in step 1 within 3 days following its completion, the officer/member/any involved parties may present the Grievance to the Adviser. Upon of the request of the said adviser, the Grievance shall be in writing and shall state the Grievant(s) name(s).
8.1.3 Step 3: If a satisfactory settlement is not reached in step 2 within 5 days of the date of submission of the written Grievance to the adviser, the officer/member/any involved parties may present the Grievance to the Monitoring officer of the organization from CSO. The monitoring officer or his/her designee shall schedule a meeting to be held within 14 days of receipt of the Grievance by the Adviser with the complaint of the purpose of attempting to resolve the Grievance. The Monitoring officer or his/her designee shall respond in writing with 7 days of the date of the meeting. Timeframes maybe extended in writing by mutual agreement of the parties.
8.1.4 Step 4: If the Grievance is not resolved at step 3 the complaint may will in 14 days after the Monitoring officer’s written response is due, serve written notice upon the CSO that they desire to arbitrate the Grievance, and the complaint may request Genshiken and/or CSO to furnish a panel of five arbitrators. Within ten days of the receipt of the panel of arbitrators, the party shall select an arbitrator. The complainant shall make the first and third strike and the other involved party the second and fourth strike of names. The remaining individual shall serve as arbitrator and hear the dispute. The decision of the arbitrator shall be final and binding upon the parties. The cause of the arbitration shall be borne equally by the parties, except that each party shall be responsible for the cause of any witnesses testifying on it’s behalf. Upon the mutual consent of the parties more than one Grievance maybe heard before one arbitrator.
8.1.5 Limit on Arbitrator: The Arbitrator shall have jurisdiction and authority to interpret the provisions of this constitution and shall not amend, delete or modify any of the provisions or terms of this Constitution.
Article IX
Penalties
Section 9.1. Any member that commits any offenses, either stated in this constitution , or the existing Student Handbook, maybe disciplined in the accordance set forth by this constitution, aside from the sanctions stated and set forth by the existing Student Handbook, after observance of proper investigation and establishment of guilt based due process.
Section 9.2. If a member has acquired 3 minor offenses and 1 minor offense, he/she will be disqualified from the organization, aside from the sanctions set forth by the existing Student Handbook.
Article X
Amendments and Revisions
Section 10.1. Any general or special meeting, when the majority of the Genshiken officers are present, they may propose amendments to this constitution and by-laws.
Section 10.2. This constitution and by-laws could be amended or revised. The validity of such actions will only be done when ratified three-fourths of the votes of the officer’s.
Section 10.3. If the three-fourths ratification of votes of the officers fails, then the amendment is defeated but the ratification of votes reaches half of the officers, a Constitutional Convention will be called.
Section 10.4. The Constitutional Convention (Con-Con) is composed of the officers and the members. Therefore, the validity of the amendments will only be considered when ratified by two-thirds of the votes of both officers and members, if the result remains negative, the amendment is defeated.
Article XI
General Provisions
Section 11.1. Officers
Section 3.1. Election
3.1.1. There shall be a Commission on Elections, which shall be composed of all major outgoing officers, being chaired by the President.
3.1.2. The COMELEC shall be the sole body that shall settle and/or decide all electoral disputes.
3.1.3. The COMELEC during its deliberation shall create policies for election of the incoming officers. A list of official candidates should be presented two (2) weeks before the election.
3.1.4. A pre-assembly of all the official candidates and members should take place on a day set by the COMELEC.
3.1.5. The manner of election shall be:
· Nomination
· Seconding the nomination
· Announcing the official candidates
· Casting of votes (thru secret balloting)
· Tabulation
· Declaration of winners
3.1.6. The order of election shall be from President to PRO.
3.1.7. A re-election shall take place when there is a case of a tie for the said position.
3.1.8. The election shall be scheduled two months before the final examination of the second semester.
Section 3.2. Qualifications
3.2.1. Must not hold any other position in any recognized organizations in the university upon elections.
3.2.2. Must be recommended by the general welfare of the organization.
3.2.3. Has not committed any violation on the university’s regulations.
Section 3.3. Functions and Rights
The Genshiken’s Executive Board of Officers shall be composed of the President, Vice President, Secretary, Assistant Secretary, Treasurer, Auditor, Business Manager, and Public Relations Officers (3).
3.3.1. President
(a) The President shall be the official head of Genshiken.
(b) The President shall be the overall coordinator of activities of Genshiken.
(c) The President shallpreside over all the meetings of the organization.
(d) The President shall determine the Order of Business of every meeting.
(e) The President shall have the authority to create committee/s as he/she deems necessary, authorize expenditures, and prescribe duties to other officers and members.
(f) The President shall enforce all policies approved by the Genshiken officers and members.
(g) The President shall lead the members in carrying out the activities in attaining the purpose and objectives of the organization.
3.3.2. Vice President
(a) In the absence of the President, the Vice President shall take charge.
(b) The Vice President must assist the President in carrying out the objective of Genshiken.
(c) The Vice President shall carefully monitor the performance of other officers and members, and may perscribe duties to those with implicit approval of the President.
(d) The Vice President shall perform such other duties and functions as may, from time to time, be assigned by the President.
3.3.3. Secretary
(a) The Secretary shall take down minutes of all Genshiken meetings.
(b) The Secretary shall prepare and serve due notice all meetings of the members and of the officers.
(c) The Secretary collects, maintains, and updates all documents, membership profiles, as well as records of Genshiken. The Secretary shall also have the secretarial and organizational records.
(d) The Secretary shall become the Ad-interim President of the organization in the event of vacancies in both positions of President and Vice President, until such time when the organization members elect the successors.
(e) The Secretary shall perform such other duties and functions which may be assign by the President.
3.3.4. Assistant Secretary
(a) The Assistant Secretary shall assist the Secretary in his/her duties.
(b) The Assistant Secretary shall take over on the duties of the
Secretary upon his/her absence.
(c) The Assistant Secretary shall perform such other duties and functions which may be assigned by the president.
3.3.5. Treasurer
(a) The Treasurer shall act as the custodian of all funds and properties of Genshiken.
(b) The Treasurer shall be in-charge of collecting, under proper receipts, all the fees, dues and fines from the members.
(c) The Treasurer shall disburse with accompanying vouchers all payments and expenses duly authorized by the President and the Adviser.
(d) The Treasurer shall keep books and records of accounts.
(e) The Treasurer shall make and present during every general meeting, the reports of financial operations and statements of financial condition of the organization.
(f) The Treasurer shall present for review, verification, and certification by the auditor on demand, the funds, and all records pertaining to the collections and disbursements.\
(g) The Treasurer shall co-signatory in disbursements of the organization’s funds and withdrawals from the organization’s account in banks.
(h) The Treasurer may ask assistance from other officers of the society concerning purchasing and related materials.
(i) The Treasurer shall prepare the semestral Financial Statements and reports of the organization, certified by the auditor.
(j) Upon termination of office, the Treasurer turnover to the authorized successor the money, books, record, and all other documents necessary to the treasury.
(k) The Treasurer shall perform other duties and functions which may be assigned by the president.
3.3.6. Auditor
(a) The Auditor shall audit all the accountabilities of the funds, records, original and official entries in the book, and the financial activities of the organization.
(b) The Auditor shall determine the fairness and accuracy of the presentation of the Financial Statement/Reports of the organization.
(c) The Auditor shall act as the organization’s property custodian.
(d) The Auditor shall assist the Treasurer in preparing the financial statements/reports.
(e) The Auditor shall perform other duties and functions which may be assigned by the President.
3.3.7. Business Manager
(a) The Business Manager shall assist the President and other officers in the transaction of the organization’s business.
(b) The Business Manager shall be directly responsible for maintaining a good image of Genshiken especially on external affairs.
(c) The Business Manager shall submit and present documents about the organization’s plans for an activity, a fund raising, or a project.
(d) The Business Manager shall contact the concerned people and negotiate the terms and conditions regarding the external business affairs of Genshiken after consulting the other offices.
(e) The Business Manager shall perform other duties and functions which may be assigned by the President.
3.3.8. Public Relations Officer (Internal PRO, External PRO, & PRO for On-line and Technical Affairs (PRO-OTA))
(a) The Internal PRO shall be responsible for disseminating information and other communication to other concerned parties.
(b) The External PRO shall be directly in-charge in promoting the organization’s projects, plans, activities, and undertakings.
(c) The PRO for On-line and Technical affairs shall be responsible in promoting the organization’s projects, plans, activities, and undertakings on the internet. He shall also be responsible for publications design and any computer related matters.
(d) The PROs shall inform the members of the members of the organization as regards all the meetings called upon by the officer.
(e) The PROs shall promote harmonious relationship among the members of the organization; encourage openness, free expression of ideas and one’s self, to foster healthy criticism towards greater efficiency.
(f) The PROs shall perform other duties and functions, which may be assigned by the President.
Section 3.4. Terms of Office
3.4.1. The term of office of Genshiken officers shall be for one (1) school year, unless removed or terminated earlier for just cause, and shall continue to hold such office until their successors shall have been elected and qualified.
3.4.2. Unless otherwise provided, the said term of office shall commence on the date of their induction, and shall expire upon the assumption of office of their successors.
Section 3.5. Removal, Vacancy and Impeachment
3.5.1. Vacancies may occur under following situations:
· Impeachment
· Disqualification
· Resignation
· Failure to Enroll during his term of office
3.5.2. In case of vacancies, appointments shall be made by officers. Such appointments shall follow the qualifications stated in this constitution.
3.5.3. Any Genshiken officers shall be disqualified to continue holding office under following circumstances:
· Failure to enroll during his term of office
· Permanent psychological incapacity
3.5.4. Genshiken Officers shall be subject to impeachment on any of the following grounds:
· International violation of the Constitution
· Found guilty of any violations under this Constitution and/or the University body
· Malversation of funds
· Graft and Corruption
· Misrepresentation of the organization
3.5.5. Any of Genshiken’s officers and members may initiate an impeachment complain against any of the Genshiken’s officers.
3.5.6. Cases of impeachment against any of the Genshiken officials shall be investigated, deliberated, and decided upon a committee composed of the other remaining officers, and the Adviser to maintain neutrality.
Article IV
Adviser
Section 4.1. Selection Process
4.1.1. Genshiken shall have an adviser who shall be a full-time faculty member of De La Salle University-Dasmariñas.
Section 4.2. Qualifications
(a) The Adviser shall be recommended by the majority of the Genshiken Executive Board.
(b) The Adviser should have at least one (1) year residency in the University.
Section 4.3. Duties and Responsibilities
(a) To provide guidance particular in the:
· Establishment of strategic direction
· Management of the organization’s affairs particularly in the planning, organizing, directing, and controlling process.
· Implementation of rules, policies, and procedures
· Resolution of leadership problems and cases
(b) To help establish and sustain harmonious relationship within the organization.
(c) To accompany the organization during off campus activities.
· If the Adviser will not be able to do such, the adviser must assist the organization to choose the most qualified faculty to accompany the group.
(d) To advise and give opinions on the activities and matters concerning the organization.
(e) To attend meetings on a regular basis of at least once a month.
(f) To call meetings of Genshiken officers whenever the need arises.
(g) To inform from time to time other matters coming from different offices that concerns the organization.
(h) To perform other duties and responsibilities analogous, related to, and/or implied by virtue of the position of the adviser.
Section 4.4. Terms of Office
4.4.1. The term shall be for one (1) school year, but may be renewed based on the recommendation of the organization.
Section 4.5. Vacancy
4.5.1. If the faculty adviser withdraws before his/her period expires, a new faculty should be recommended for the remaining term.
Article V
Members
Section 5.1. Qualifications
5.1.1. Must be a bonafide student of University.
5.1.2. Must have interest on Anime and other Modern Visual Art.
Section 5.2. Membership
5.2.1. Students that are joined in Genshiken are officially members for one (1) semester, renewable every semester.
5.2.2. Requirement for the members of Genshiken will be held every semester.
5.2.3. Members of Genshiken shall pay a semestral fee payable in cash.
The fee collected shall be resolved by the executive board.
5.2.4. Membership Requirements:
· An accomplished application form
· Two (2) pictures of size 1”x1”
· Copy of the current Registration Form
· List of schedule for the current semester
· Membership Fee
Section 5.3. Functions and Rights
5.3.1. Members of Genshiken shall have the following right and privileges:
(a) The right to participate in the discussion in all the meetings of the organization.
(b) The right to vote, be elected and/or appointed to any official position in Genshiken , provided that he/she complies with all the requirements.
(c) The right to be informed of any project and/or activities of the organization and to participate in such undertaking.
(d) The right to use facilities of the organization provided that it will be used for official business.
(e) The right to volunteer for the well-being of the organization.
(f) The right to participate the objectives of Genshiken thru the vision-mission of the De La Salle University.
5.3.2. Members of Genshiken shall have the following expressed duties
and responsibilities:
(a) The duty to attend meetings, whether regular or special called upon by the executive board.
(b) The duty to comply with the provisions of this constitution and other rules that may be promulgated or agreed upon by the organization.
(c) The duty to attend and participate actively in all of the organization’s activities and functions.
(d) The duty to pay the membership fee and such other fees that may be due in accordance with the constitution.
(e) The duty to comply with any lawful requirements set forth by the organization.
(f) The duty to join a committee in line with his/her interest that would further develop his/her skills.
(g) The duty to attend committee meetings and activities as called by the committee head.
Section 5.4. Termination of Membership
5.4.1. Membership shall be forfeited under the following:
· Being found guilty three (3) times in any of the minor offenses of this constitution or the university body
· Being found guilty in any of the major offenses of this constitution or the university body
· Intentional violation of the constitution
· Found guilty of committing graft, corruption of funds, and anomalies
· Withdrawal of membership / disqualification
· Failure to enroll during his/her term of membership
· Unexcused absence to three (3) activities
Section 5.5 Committees
5.5.1 Art Committee
5.5.1.1 The Art Committee shall be responsible for the artistic side of the members.
5.5.1.2 The Art Committee shall be responsible in forming the drawing tutor team.
5.5.1.3 The Art Committee shall be responsible in providing designs for the organization.
5.5.2 Cosplay Committee
5.5.2.1 The Cosplay Committee Shall be responsible in matters regarding the field.
5.5.2.2 The Cosplay Committee shall be the official cosplay team of the organization.
5.5.3 Performance Committee
5.5.3.1 The Performance Committee shall be responsible for the development of the members’ talents.
5.5.3.2 The Performance Committee shall be the official performers of the organization.
5.5.4 Events management and Productions Committee (EMPC)
5.5.4.1 The EMPC shall be responsible for events preparations and setup.
5.5.4.2 The EMPC shall be responsible for ensuring the good flow of activities.
5.5.4.3 The EMPC shall be the activity marshals.
5.5.5 Publications Committee
5.5.5.1 The Publications Committee shall be responsible for production of Manga, Comics, and other similar works with the help of the Art Committee.
Article VI
Funds
Genshiken’s fund will be composed of membership fee and proceeds from fundraising activities.
Section 6.1 Genshiken shall raise funds to defray its expenses, and to accomplish its objectives and functions.
Section 6.2 Genshiken may conduct a Fundraising Activity. The proceeds of which shall be used to defray its expenses, and to accomplish its objectives and functions.
Section 6.3 Genshiken shall collect membership fees that are reasonable in amount and approved by the executive board.
Section 6.4 Genshiken shall not collect any other dues unless approved by the majority of its constituents.
Section 6.5 Funds not used by the organization during their term shall be transferred to their succeeding officers.
Section 6.6 Transparency and proper accounting shall be observed at all times. Person(s), which will be proven guilty of fraud shall be held liable for their acts.
Article VII
Order of Meetings
Section 7.1 The President shall call the monthly meeting of officers and members at least once a month.
Section 7.2 During the meeting, the President shall render his/her monthly report regarding the activities of the organization.
Section 7.3 Special meetings shall be called by the President whenever needed.
Section 7.4 The Majority shall constitute a quorum present shall be sufficient present a motion.
Section 7.5 Officer shall meet at least twice a month
Section 7.6 The President may call special officer’s meeting anytime designated by him/her.
Section 7.7 Order of business
· Roll call
· Reading and approval of the minutes of the previous meeting
· Report of committees
· Action of committee reports
· Other matters
Article VIII
Grievance Procedures
Any dispute which may arise from an officer’s/member’s/any involved parties’ complaint with respect to the interpretation of the terms and condition of this Constitution shall be subject to the following Grievance Procedure, unless expressly excluded from such procedures by the terms of this Constitution. All Grievances shall be initiated at Step 1. Time limits set fourth herein maybe extended upon mutual agreement of the parties. The involved parties shall have the right to be notified and be present at all steps of the Grievance Procedure.
8.1.1 Step 1: An officer, a member, or any involved party shall present the Grievance to the most immediate officer of the organization who has the authority to make adjustments in the matter within 14 days of the alleged Grievance of knowledge thereof.
8.1.2 Step 2: If a satisfactory settlement is not reached in step 1 within 3 days following its completion, the officer/member/any involved parties may present the Grievance to the Adviser. Upon of the request of the said adviser, the Grievance shall be in writing and shall state the Grievant(s) name(s).
8.1.3 Step 3: If a satisfactory settlement is not reached in step 2 within 5 days of the date of submission of the written Grievance to the adviser, the officer/member/any involved parties may present the Grievance to the Monitoring officer of the organization from CSO. The monitoring officer or his/her designee shall schedule a meeting to be held within 14 days of receipt of the Grievance by the Adviser with the complaint of the purpose of attempting to resolve the Grievance. The Monitoring officer or his/her designee shall respond in writing with 7 days of the date of the meeting. Timeframes maybe extended in writing by mutual agreement of the parties.
8.1.4 Step 4: If the Grievance is not resolved at step 3 the complaint may will in 14 days after the Monitoring officer’s written response is due, serve written notice upon the CSO that they desire to arbitrate the Grievance, and the complaint may request Genshiken and/or CSO to furnish a panel of five arbitrators. Within ten days of the receipt of the panel of arbitrators, the party shall select an arbitrator. The complainant shall make the first and third strike and the other involved party the second and fourth strike of names. The remaining individual shall serve as arbitrator and hear the dispute. The decision of the arbitrator shall be final and binding upon the parties. The cause of the arbitration shall be borne equally by the parties, except that each party shall be responsible for the cause of any witnesses testifying on it’s behalf. Upon the mutual consent of the parties more than one Grievance maybe heard before one arbitrator.
8.1.5 Limit on Arbitrator: The Arbitrator shall have jurisdiction and authority to interpret the provisions of this constitution and shall not amend, delete or modify any of the provisions or terms of this Constitution.
Article IX
Penalties
Section 9.1. Any member that commits any offenses, either stated in this constitution , or the existing Student Handbook, maybe disciplined in the accordance set forth by this constitution, aside from the sanctions stated and set forth by the existing Student Handbook, after observance of proper investigation and establishment of guilt based due process.
Section 9.2. If a member has acquired 3 minor offenses and 1 minor offense, he/she will be disqualified from the organization, aside from the sanctions set forth by the existing Student Handbook.
Article X
Amendments and Revisions
Section 10.1. Any general or special meeting, when the majority of the Genshiken officers are present, they may propose amendments to this constitution and by-laws.
Section 10.2. This constitution and by-laws could be amended or revised. The validity of such actions will only be done when ratified three-fourths of the votes of the officer’s.
Section 10.3. If the three-fourths ratification of votes of the officers fails, then the amendment is defeated but the ratification of votes reaches half of the officers, a Constitutional Convention will be called.
Section 10.4. The Constitutional Convention (Con-Con) is composed of the officers and the members. Therefore, the validity of the amendments will only be considered when ratified by two-thirds of the votes of both officers and members, if the result remains negative, the amendment is defeated.
Article XI
General Provisions
Section 11.1. The contents of this code shall not be contrary to the Vision-Mission of DLSU-D and the constitution set forth by it’s mother organization, the Council of Student Organizations.
Section 11.2. This constitution shall be effective upon the recommendation of the President and Adviser of the said Recognized Student Organization subject to the approval of the Council of Student Organizations and Student Development Activities Office.l of Student Organizations.
